01Who we are and what this covers
HireCole is operated by High Arc Media, Inc., a Georgia corporation ("HireCole", "we"). These terms govern your use of the HireCole service: the AI employee we call Cole, the web application, and the outreach infrastructure we provision on your behalf. By creating an account you agree to them on behalf of the business you represent ("you").
Version 0.9. These terms are in effect for every account from sign-up and are under review by counsel; where the published version changes, we tell you by email and inside the app before it applies to you.
02What the service does
HireCole helps your business send cold outreach email to other businesses in the United States. Cole interviews you, builds a list of people from licensed third-party data or from lists you supply, drafts emails in your voice, sends approved emails through sending addresses we provision for you, and sorts replies.
Cole's level of autonomy is set by you through the trust ladder in the product. Cole never sends a reply to a human being without your explicit approval of that specific reply, at any trust level.
03Eligibility and prohibited businesses
You must be a business sending to other businesses. HireCole is not available to, and may not be used to promote: credit repair services, payday or short-term consumer lending, firearms, ammunition or weapons, adult content or services, tobacco, cannabis or marijuana products, or any business whose outreach would constitute a consumer report or be governed by the Fair Credit Reporting Act. We ask about this at sign-up. Answering inaccurately is grounds for immediate termination without refund.
We review the first campaign on every new account before anything sends. We may decline to run a campaign that we judge misleading, unlawful, or likely to harm the shared sending infrastructure.
04Your responsibilities as the sender
Every email goes out in your name from a sending address provisioned for you. You are the sender under applicable law. You agree that your emails will comply with the CAN-SPAM Act and every other law that applies to you, including an accurate sender, a truthful subject line, a valid physical postal address, and a working opt-out, all of which the product inserts and which you may not remove or disable.
You will not make false, deceptive or unsubstantiated claims about your business, your results, or anyone else's. You will honor every opt-out immediately and will not re-add an opted-out recipient. You will not upload or import contact lists you do not have the right to use, including purchased lists. You will not send to recipients outside the United States; the product excludes the EU, UK and Canada by default and we do not currently support sending there.
You remain responsible for every email approved under your account, whether approved by you, by a team member you invited, or by Cole operating at an autonomy level you set.
05Sending limits, reputation, and our right to stop
Daily sending caps, warmup schedules and sending windows are set by the product and may not be overridden. If your account's bounce rate exceeds 3 percent or its complaint rate exceeds 0.3 percent over seven days, Cole stops sending automatically and tells you why.
We may throttle, pause, rotate sending domains for, or suspend any account whose sending we reasonably believe threatens deliverability, violates these terms, or generates abuse reports, with or without notice depending on severity. We may also pause all sending across the service in an emergency.
06People data: what you get and what you may do with it
Information about people shown to you in HireCole (names, titles, companies, work email addresses and related business contact information) is licensed to us by third-party data providers, principally People Data Labs, Inc., and sub-licensed to you only for use inside HireCole for the outreach the product performs.
You may export the people in your account for your own records. You may not resell, sublicense, distribute, publish or otherwise make that data available to any third party, use it to build, train, enrich or improve any database or product, use it in connection with any consumer report or eligibility decision, or use it for any purpose in the prohibited list above. People who ask our data providers to opt out are removed from your lists without notice.
Contact information you bring to HireCole yourself remains yours, and the restrictions above do not apply to it.
Our agreement with People Data Labs requires that restrictions at least as strict as theirs apply to you, including: no reselling, sublicensing or distributing the data or anything derived from it; no copying, modifying, reverse engineering or preparing derivative works; no use of their marks; no building products that resemble or compete with theirs; no programmatic access that exposes a substantial set of the data; and compliance with their Acceptable Data Use Policy. By using HireCole you agree to those restrictions directly, and you acknowledge that People Data Labs may review these terms.
07Your content and Cole's drafts
You own the emails you write, the emails you approve, and the information you give Cole about your business. You grant us a licence to use that content to operate the service for you, including to draft, send, and improve Cole's work for your account. Edits you make to Cole's drafts are stored alongside the originals and used to improve Cole's drafts for you.
We use anonymised, aggregated performance data across accounts (for example, reply rates by email length) to improve Cole for everyone. We do not use your emails, your people, or your replies to train models for other customers.
08Infrastructure we provision for you
On the managed plans we register lookalike domains, create mailboxes, configure DNS and set up sending infrastructure on your behalf through third-party providers. Domains are registered in HireCole's name and operated by us for the length of your subscription; on request at termination we will transfer a domain to you where the registrar allows it. Mailboxes and sending infrastructure are released 30 days after termination.
We do not guarantee any particular inbox placement rate. Deliverability depends on factors outside our control, including recipient mail servers and your own content.
09Trial, fees and billing
Every new account starts with a 14-day free trial with no card required. Warmup runs during the trial. At the end of the trial, sending pauses until a card is added; nothing is deleted.
Plans are billed monthly in advance. Each plan includes a monthly allowance of people Cole may find and contact. Unused allowance does not roll over. When the allowance is used, Cole pauses finding new people until the next cycle or an upgrade; there are no overage charges. Plan changes take effect at the next billing date unless we agree otherwise.
If a payment fails you have a 7-day grace period before sending pauses. Nothing is deleted over a failed payment. Fees are non-refundable except where the law requires otherwise or where we have failed to provide the service.
10Cancellation and termination
You may cancel at any time from the Billing page. Sending stops the same day, and your account data stays for 30 days so you can export it, after which it is deleted. Cancellation takes effect at the end of the paid period; there is no refund for the remainder of a month.
We may suspend or terminate your account for breach of these terms, for non-payment, or where required by a data provider or by law. On termination for breach there is no refund.
11Privacy
How we handle your data and the data of the people Cole contacts is described in our Privacy Policy, which is part of these terms.
12Disclaimers and limits
The service is provided as is. To the fullest extent permitted by law we disclaim all warranties, and our total liability to you for any claim arising from the service is limited to the fees you paid us in the three months before the claim. We are not liable for indirect, consequential or lost-profit damages. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.
You will indemnify us against claims arising from the content of your emails, your use of people data outside these terms, or your breach of applicable law.
13General
These terms are governed by the laws of the State of Georgia, and any dispute will be brought in the state or federal courts located in Fulton County, Georgia. If any part of these terms is unenforceable, the rest stays in effect. These terms are the whole agreement between us about the service. Questions: contact@higharcmedia.com.
